The 2016 Summer Olympics in Rio captured the attention of the world – and also spawned a record-setting number of high-profile disputes involving athletes from countries around the globe, competing in a broad range of Olympic events.
Nicknamed the “Supreme Court of Sport,” the Court of Arbitration for Sport (“CAS”), a special international arbitral institution headquartered in Lausanne, is charged with deciding such Olympics disputes, generally within 24 hours (or less).
The CAS’s Ad Hoc Division has operated on-site at each Summer and Winter Olympics since Atlanta 1996, deciding disputes such as athlete qualifications and eligibility, disciplinary matters, and challenges to the results of competition, as well as appeals in doping cases. In Rio, the 12 arbitrators of the Ad Hoc Division heard a whopping 28 cases (besting the previous record of 15 cases set at the 2000 Sydney Summer Olympics). In addition, this year, for the first time in history, doping-related disputes (previously first heard by the International Olympic Committee) were decided in the first instance by a second CAS Division, the Anti-Doping Division, also sited in Rio.
The specialization of its arbitrators, the flexibility and speed of its procedure, its publication of persuasive authority in appeals cases, and the international respect that it has earned have made CAS the preferred forum worldwide for lex sportiva.
